Acceptable Use Policy

This Acceptable Use Policy ("Policy") applies to all users of the Banks platform, including appraisers, clients, and referral partners (collectively, "Users"). By checking the acceptance box presented on the Platform, or by accessing or using Banks, you acknowledge that you have read, understood, and agree to comply with this Policy. When you check the acceptance box, the Platform records your name and the date and time of your acceptance, and that record constitutes your electronic agreement to this Policy. Capitalized terms not defined here have the meanings given in the General Terms and Conditions ("Terms").
1. Purpose
This Policy is intended to ensure that Banks remains a safe, professional, and trustworthy marketplace for appraisal services. All Users are expected to conduct themselves with honesty, professionalism, and respect for others.
2. Prohibited Conduct
Users may not use Banks to:
- a) Misrepresent credentials, licensure status, experience, or qualifications;
- b) Submit false, misleading, or fraudulent information in connection with any Engagement;
- c) Harass, threaten, or engage in abusive conduct toward any other User or Banks personnel;
- d) Solicit or accept appraisal engagements outside of Banks in circumvention of the Terms;
- e) Upload, transmit, or distribute content that infringes any third-party intellectual property rights;
- f) Use Banks for any purpose that violates applicable federal, state, or local law, including applicable appraisal licensing laws and USPAP;
- g) Attempt to gain unauthorized access to any part of Banks or another User's account; or
- h) Advertise, promote, or solicit business for any other appraisal management company, marketplace, platform, or service that performs a function similar to Banks, whether through a User's profile, direct messages, or any other communication facilitated through Banks.
3. Prohibited Engagement Types
Appraisers may not use Banks to accept or perform any appraisal assignment that is intended, in whole or in part, for use in connection with a lending transaction, including any assignment ordered by, prepared for, or reasonably expected to be relied upon by a lender, mortgage broker, loan servicer, or other party involved in originating, underwriting, refinancing, modifying, or servicing a loan.
Users who are uncertain whether a particular assignment falls within this prohibition must contact Banks before accepting the engagement. Accepting a lending-related engagement through Banks is a material violation of this Policy, regardless of whether the User believed in good faith that the assignment was permitted.
4. Enforcement
Banks reserves the right to investigate any suspected violation of this Policy. Upon finding a violation, Banks may, in its sole discretion, issue a warning, suspend access, or permanently terminate a User's account.
Violations of this Acceptable Use Policy may result in suspension, restriction, or termination of access to the Platform, in addition to any other remedies available to Banks under the Terms or applicable law.
Banks' exercise of these rights does not create any obligation to act in any particular case or to monitor Banks for violations.

Users who become aware of conduct that may violate this Policy are encouraged to report it to Banks at legal@gethomevault.com.
